Batavia Music Buffs 2016 Hawaii Vacation Raffle Disclaimer/Restrictions

The Batavia Music Buffs Hawaii Vacation Raffle to benefit the BPS101Batavia High School Music Programs is conducted by the Batavia Music Buffs, a non-profit organization under the laws of Illinois. The raffle is governed by the State of Illinois (230 ILCS 15) Raffles Act. By purchasing a raffle ticket, you agree to be bound by these rules.

  1. The purchase price for one raffle ticket is $5.00, 3 raffle tickets is $10.00 and 8 raffle tickets is $20.00.  No more than 8,000 tickets will be sold.
  2. Ticket entries can be purchased from participating Batavia High School Music Students, Batavia Music Buffs website or from a Batavia Music Buffs Board Member, Committee Member or Member Volunteer.
  3. Tickets may be purchased with cash or check. If an Entrant’s check is returned unpaid by the bank, the entry ticket(s) will be invalid unless a cash payment is received by Batavia Music Buffs by 5 p.m. Central Time Wednesday, February 25, 2016, the official raffle deadline. Entrant will also be subject to all associated bank fees.
  4. All entry purchases are final and non-refundable.
  5. Entrant will retain the original printed raffle ticket.  The stub will be entered into the drawing and will be retained by Batavia Music Buffs.
  6. U.S. Postal regulations prohibit the mailing of raffle tickets.  Tickets purchased online require in-person pick up or personal delivery.
  7. All unsold tickets and proceeds from the raffle ticket sales must be received by Batavia Music Buffs no later than 5 p.m. Central Time Wednesday, February 25, 2016. If received after the official deadline, all monies will be returned to Entrant(s) and all associated tickets will be invalid. Additional tickets may be purchased with cash through Batavia Music Buffs at the 5th Annual Gala Event until 8:45 p.m. on the drawing date, February 27, 2016.
  8. The winner of the raffle will be determined by random drawing. The drawing will take place on Friday, February 27, 2016 at approximately 9:30p.m. Central Time at Batavia Music Buffs 7th Annual Gala held at Fishermen’s Inn Banquets 43W901 Main Street Rd, Elburn, IL 60119.  This information will also be announced on the Non-Profit’s website at www.bataviamusicbuffs.org. Entrant(s) do not need to be present to win.
  9. Winners agree to comply with all IRS regulations regarding raffle winnings. Winner(s) agree to furnish Batavia Music Buffs with his/her social security number, verify his/her identity, and sign all required IRS documents (IRS Form 1099) before claiming prize.
  10. The winner of the raffle is entitled to an 8 day/7 night stay at HGVC Hawaiian Village Lagoon Tower on the island of Oahu or at King’s Land Waikoloa on The Big Island. At least one member of the winner’s traveling party must be a responsible adult at least 25 years of age. Accommodations vary by location.  Winner shall meet with the owner of the property to make arrangements for vacation location and any/all location details related thereto. 
  11. Winner will assume and be responsible for all airfare, meals, tips, incidentals, preparation, shipping and all other fees, and local, state, and federal taxes, including but not limited to all applicable sales, use, luxury, income, and special taxes associated with winning a raffle. Batavia Music Buffs specifically disclaims all expressed or implied warranties, including without limitations warranties of merchantability. Batavia Music Buffs is not responsible for any losses or injuries suffered as a result of the vacation prize.
  12. The winner of the raffle must claim the prize within 14 days of the drawing. If the winner does not claim the prize within 14 days of the drawing, by responding to telephonic or written notice from Batavia Music Buffs or otherwise, the prize will be forfeited. After the prize is claimed, winner must abide by any restrictions placed on voucher by the issuing donor (e.g. expiration date for use).
  13. Winner must book travel by 12/31/16 and must use accommodations by 12/31/17.
  14. If Batavia Music Buffs has not received by 8:45 pm Central Time, February 27, 2016, at least 750 valid raffle tickets and full payment therefore, Batavia Music Buffs may, at its sole and absolute discretion, cancel the raffle and withdraw the prizes aforementioned or decide to delay the drawing until the minimum has been purchased. In such an event, Batavia Music Buffs will refund in full all monies collected to all persons who made payment, if they do not want to participate in a delayed drawing or if the raffle is canceled.
  15. Purchasers of raffle tickets must legibly write their full names, addresses, email, and telephone numbers on each individual ticket stub. If more than one name stated on a ticket stub, the first listed name shall be the Entrant. Batavia Music Buffs shall, will and can have no obligation for payment or delivery of any prize to any person other than the Entrant. It is the sole responsibility of the entrant to allocate any such prize among the participants in any multiple party entry.
  16. Any drawing may be postponed due to weather or any state of emergency declared by the Mayor of Elburn, The Governor of Illinois, or the President of the United States. In such event, a new date, place and time for the drawing will be determined by Batavia Music Buffs, which will be announced on Batavia Music Buffs’ website.
  17. Purchasers of tickets, by participating in the raffle, release Batavia Music Buffs, its directors, officers, members and agents from any and all liability, loss or claim arising out of any raffle prize, expressly waive any such claim and agree that the liability, if any, of the Batavia Music Buffs, its directors, officers, members and agents shall be limited to the raffle ticket price paid.  Batavia Music Buffs makes no express or implied warranty as to the Raffle prize.
  18. Any and all disputes, claims and controversies concerning this raffle shall be submitted to and resolved by binding arbitration, to be conducted under arbitration rules in the state of Illinois.
  19. Prize is not redeemable for cash.
  20. Raffle is void where prohibited.
  21. Winner(s) agree to allow Batavia Music Buffs to publish their names and photographs on the Batavia Music Buffs’ website.
